PROMOTIONAL GAME OFFICIAL RULES

By participating in any promotional game (each, a “Promotional Game”) that may be sponsored or made available by the operator of the location at which you are using the Software (the “Operator”) as part of the Software or any Auction, you fully and unconditionally agree to and accept, in addition to the Terms and Conditions to which you are subject in connection with any use of the Software or participation in any Auction (the “Terms and Conditions”), these promotional game official rules (these “Promotional Game Official Rules”) and any decisions of the Operator with respect to any Promotional Game, which shall be final and binding (as between you and the Operator) in all such matters. Capitalized terms used herein but not otherwise defined herein shall have the meanings assigned to them in the Terms and Conditions.
HOW TO ENTER
For every bid you purchase from the Operator, you will receive from the Operator, free of charge, one (1) game piece for the Promotional Game. You may also obtain a free game piece for the Promotional Game by following the “no-purchase-necessary method of entry” rules as set forth below. You may reveal the content of your electronic game piece(s) by using the onscreen options.
NO-PURCHASE-NECESSARY METHOD OF ENTRY
As an alternate means of obtaining a free game piece for the Promotional Game, you may either (i) mail a legible photocopy of your driver’s license or other government identification and a legibly handwritten request for a game piece, providing your First and Last Name, Complete Mailing Address (e.g., Street, City, State, ZIP code), Telephone Number, Date of Birth, Age and Email Address to the address of the Operator location at which you are using or accessing the Software (the “Operator Address”), or (ii) present your driver’s license at the Operator’s location from which you are using or accessing the Software and request a game piece for the Promotional Game. Approved submissions and requests will receive one (1) game piece for the Promotional Game. For a list of winners, you may mail a request for such information to the Operator at the Operator Address.
The Operator will not be responsible for any lost, illegible, incomplete, stolen, misdirected, mutilated or postage-due mail. Limit of one (1) no-purchase-necessary request per person, per day. Any submissions made by mail as set forth in clause (i) above must be received within one (1) year of the Start Date (as defined herein).
PROMOTIONAL PERIOD
The promotional period begins on the date shown at the upper left corner of your screen (the “Start Date”) at 12:00 a.m. Eastern time (ET), and ends on the earlier of (i) the first (1st) anniversary of the Start Date, or (ii) the date on which all available game pieces for the Promotional Game have been distributed; provided, however, that the Operator reserves the right to shorten, extend, suspend, modify or cancel the promotional period or the Promotional Game, at its discretion, at any time (subject to the prior written approval of Redibids).
Any prizes may be claimed from the Operator at the location where you won the prize.
RESTRICTIONS AND RELEASES
Prize winners are solely responsible for all federal, state and local taxes. All Promotional Games are void where prohibited by law. The Operator reserves the right to cancel, suspend or modify any Promotional Game if fraud, technical failures or any other factor impairs the integrity of the Promotional Game, as determined by the Operator in its sole discretion (or in any case where Redibids directs the Operator to take any such action). The Operator reserves the right in its sole discretion to disqualify you or any other individual it finds to be tampering with any Promotional Game, or to be acting in violation of these Promotional Game Official Rules or the Terms and Conditions (and Redibids reserves the right to cause the Operator to take any such action).
Any attempt to damage or affect the legitimate operation of any Promotional Game is a violation of criminal and civil laws and, should such an attempt be made, the Operator and Redibids each reserve the right to seek damages from all responsible parties to the fullest extent permitted by law. By participating in any Promotional Game, you agree not to contest the outcome of any Promotional Game and to fully comply with these Promotional Game Official Rules and the Terms and Conditions.
You agree to hold harmless the Operator and Redibids and their respective affiliates, and the directors, officers, members, employees, attorneys and affiliated organizations and agents of each of the foregoing, for any damage, injury, death, loss or other liability that may result or be incurred by you or any other person from (i) participating in any Promotional Game, or the receipt or use of any prize won in any Promotional Game; (ii) any unauthorized human intervention in any Promotional Game; (iii) any technical errors related to computers, printers, servers, providers or telephone or network lines; (iv) any errors in the administration of any Promotional Game; or (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, by your participation in any Promotional Game.
ELIGIBILITY
The Promotional Game is open to any individual that is a U.S. resident eighteen (18) years of age or older that has accepted these Promotional Game Official Rules and the Terms and Conditions, unless such individual is a resident of any state or jurisdiction where any Promotional Game or the Software or any Auction (or your use thereof or participation therein) is prohibited by law, as determined by either the Operator or Redibids, in its sole discretion.
Employees and contractors of the Operator and Redibids, and their respective family members (defined as parents, spouses (including domestic partners), siblings and children) and any other persons residing in the same household as an employee or contractor of the Operator and Redibids, may not under any circumstances participate in any Promotional Game or win any prize in any Promotional Game.
ODDS OF WINNING
The odds of winning are available and can be accessed through the settings tab located onscreen to the left of the “Game Pieces” field. Buying bids will not increase your chances of winning any Promotional Game. Your chances of winning a prize in any Promotional Game is the same regardless of whether you made a bid purchase from the Operator or used the alternative method of entry.
LIMITATIONS OF LIABILITY
UNDER NO CIRCUMSTANCE WILL THE OPERATOR OR REDIBIDS OR ANY OF THEIR RESPECTIVE AFFILIATES BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES OTHER THAN DIRECT DAMAGES, ARISING OUT OF YOUR PARTICIPATION IN ANY PROMOTIONAL GAME OR YOUR RECEIPT OF (OR FAILURE TO RECEIVE) ANY PRIZE, INCLUDING, WITHOUT LIMITATION, ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, EXEMPLARY OR OTHER DAMAGES OF ANY KIND, EVEN IF THE APPLICABLE PARTIES ARE ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. YOU FURTHER AGREE THAT THE AGGREGATE LIABILITY OF THE OPERATOR AND REDIBIDS AND THEIR RESPECTIVE AFFILIATES, IF ANY, ARISING OUT OF A LEGAL CLAIM OF ANY KIND RELATING TO ANY PROMOTIONAL GAME OR THESE PROMOTIONAL GAME OFFICIAL RULES WILL NOT EXCEED FIVE HUNDRED AND NO/100 DOLLARS ($500).
PUBLICITY
Except where prohibited by law, participation in any Promotional Game constitutes your irrevocable consent to any use by the Operator or Redibids or any of their respective affiliates of your name, likeness, voice, opinions, hometown and state, in each case for promotional purposes in any media, worldwide, without payment or consideration.
CHANGES TO PROMOTIONAL GAME OFFICIAL RULES
The Operator (with the prior written approval of Redibids) may change or modify these Promotional Game Official Rules from time to time. By continuing to use or access the Software following the posting of such changes or modifications, you agree to be bound by these Promotional Game Official Rules, as they may be changed or modified from time to time.
MISCELLANEOUS
The terms and conditions set forth in these Promotional Game Official Rules shall be supplemental, and in addition to, the provisions set forth in the Terms and Conditions, and the Terms and Conditions (including the provisions set forth in Sections 7, 8, 11, 12, 13 and 14 thereof) shall apply in all cases to any Promotional Game that may be offered or made available by the Operator. You expressly acknowledge and agree that the arbitration and class waiver provision set forth in Section 13 of the Terms and Conditions shall apply to any Promotional Game and any dispute relating thereto, and the provisions of Section 13 of the Terms and Conditions shall be deemed incorporated into these Promotional Game Official Rules by and through this reference. Any failure by the Operator or Redibids to enforce any provision of these Promotional Game Official Rules shall not constitute a waiver of such provision.
These Promotional Game Official Rules will be governed and construed in accordance with the internal laws of the State of Georgia (except to the limited extent set forth in Section 13 of the Terms and Conditions), without regard for its conflict of law principles. Any action to enforce any arbitration proceeding provided for in Section 13 of the Terms and Conditions, and any other claim or dispute that you may have with or against the Operator or Redibids, to the extent arising under or relating to these Promotional Game Official Rules or any Promotional Game that may be offered or made available by the Operator and that is not otherwise subject to mandatory arbitration pursuant to Section 13 of the Terms and Conditions, shall be filed exclusively in a state or federal court located in Fulton County, Georgia, and you consent to such forum and waive any objection that you may have to the laying of venue in such forum.
